水利工程启闭机使用许可管理办法
（2010年10月10日水利部令第41号公布，2015年12月16日水利部令第47号修改，自2010年12月1日起施行）
(promulgated by Decree No. forty-first of the Ministry of water resources in December 16, 2015, amended by order No. forty-seventh of the Ministry of water resources in October 10, 2010, and implemented as of December 1, 2010)
第一条 为了加强对水利工程启闭机质量的监督管理，保障水利工程运行安全，根据《中华人民共和国行政许可法》、《国务院对确需保留的行政审批项目设定行政许可的决定》，制定本办法。
Article 1 in order to strengthen the supervision and management and close machine on the quality of water conservancy project, to ensure the safe operation of water conservancy project, according to the "People's Republic of China administrative licensing law", "State Council on the need to retain administrative examination and approval of the administrative licensing decision", formulated.
第二条 水利工程启闭机生产及使用许可的实施和监督管理，适用本办法。列入《特种设备安全监察条例》规定的特种设备目录的，适用该条例。
These measures are applicable to the implementation and supervision of the production and use licenses of the second water conservancy works. The regulations shall be applicable to the catalogue of special equipment specified in the regulations on the supervision and control of special equipment safety.
本办法所称启闭机，是指水利工程中用于开启和关闭闸门、起吊和安放拦污栅的专用设备。
The term hoist is used to open and close the gate, lifting and placing rack special equipment for water conservancy project.
第三条 国务院水行政主管部门负责启闭机生产及使用许可的实施和监督管理工作。
The third Department of water administration under the State Council shall be responsible for the implementation and supervision of the production and use of the hoist.
第四条 生产启闭机的企业，应当按照本办法规定向国务院水行政主管部门申请取得水利工程启闭机使用许可证。
Fourth enterprises that produce the hoist shall, in accordance with the provisions of these measures, apply to the administrative department of water administration under the State Council for the license for the opening and closing of water conservancy projects.
企业未取得水利工程启闭机使用许可证的，不得参加水利工程启闭机的投标，其生产的启闭机禁止在水利工程中使用。
If the enterprise fails to obtain the license for the opening and closing of the water conservancy project, it may not participate in the bidding of the water conservancy project hoist, and its production hoist shall not be used in the water conservancy project.
第五条 申请水利工程启闭机使用许可证，应当具备下列条件：
Article fifth application for water conservancy project hoist use permit, should have the following conditions:
（一）具有企业法人资格；
(1) having the legal personality of an enterprise;
（二）具有与生产启闭机相适应的专业技术人员和特殊工种人员；
(two) professional and technical personnel and special types of personnel who are compatible with the production of headstock gear;
（三）具有与生产启闭机相适应的生产设备、工艺装备、计量器具和检测设备；
(three) production equipment, process equipment, measuring instruments and testing equipment suitable for production of headstock gear;
（四）具有有效运行的质量管理体系；
(four) quality management system with effective operation;
（五）启闭机产品质量达到有关技术标准的要求；
(five) the product quality of hoist is up to the requirement of relevant technical standards;
（六）法律法规规定的其他条件。
(six) other conditions stipulated by laws and regulations.
前款第（二）、（三）、（四）项规定条件的具体要求见附件。
The specific requirements for conditions stipulated in the preceding paragraph (two), (three) and (four) are attached to the annex.
第六条 申请水利工程启闭机使用许可证，应当提交以下申请材料：
The sixth application for water conservancy project hoist use permit, should submit the following application materials:
（一）申请书一式两份；
(1) the application form is made in two copies;
（二）企业法人营业执照复印件；
(two) photocopies of the business license of the enterprise as legal person;
（三）专业技术人员、特殊工种人员名单；
(three) list of professional and technical personnel and persons of special type of work;
（四）主要生产设备、工艺装备、计量器具和检测设备清单；
(four) list of main production equipment, process equipment, measuring instruments and inspection equipment;
（五）质量管理体系相关材料；
(five) quality management system related materials;
（六）生产的启闭机在水利工程中使用的情况。
(six) the use of the hoist in the water conservancy project.
申请人应当在申请书中明确拟申请使用许可证的启闭机产品的型式和规格；申请两种以上型式的，可以一并提出申请。启闭机产品的型式和规格划分见附件。
Should the applicant intends to apply for the types and specifications of products and close machine use permits in the application explicitly; for more than two kinds of types, can apply together. The types and specifications of the headstock products are attached.
申请人应当如实提交有关材料，并对申请材料的真实性负责。
The applicant shall faithfully submit the relevant materials and be responsible for the authenticity of the application materials.
第七条 国务院水行政主管部门收到申请材料后，应当依法作出是否受理的决定，并向申请人出具书面凭证。申请材料不齐全或者不符合法定形式的，应当在5个工作日内一次告知申请人需要补正的全部内容。
The seventh department of water administration under the State Council shall, upon receipt of the application materials, make a decision on whether to accept it according to law, and issue a written certificate to the applicant. If the application materials are incomplete or do not conform to the statutory form, the applicant shall inform the applicant of all the contents that need to be corrected within 5 working days.
第八条 国务院水行政主管部门受理申请后，组织对企业应当具备的条件进行核查；核查自受理申请之日起20个工作日内完成；核查合格的，通知企业开展产品质量检测。企业应当自收到通知之日起20个工作日内提交产品质量检测报告。
Eighth water administrative department of the State Council after receiving the application, the organization shall have on business conditions for verification; verification from the acceptance of completed within 20 working days of the date of application; check, notify the enterprises to carry out product quality inspection. The enterprise shall submit the product quality test report within 20 working days from the date of receipt of the notification.
第九条 产品质量检测由按照《水利工程质量检测管理规定》取得金属结构类甲级资质的水利工程质量检测单位承担。质量检测单位应当按照有关标准和要求抽取样机进行检测，出具产品质量检测报告，并对产品质量检测报告负责。
Ninth products quality testing in accordance with the "water conservancy project quality inspection management regulations" to obtain metal structure class a qualification of water conservancy project quality testing unit to undertake. The quality testing unit shall take samples from the prototype in accordance with the relevant standards and requirements, and issue a product quality test report, and be responsible for the product quality test report.
第十条 国务院水行政主管部门应当根据核查情况和产品质量检测报告，自受理申请之日起20个工作日内（不包括核查、产品质量检测所需的时间）作出是否许可的决定。符合条件的，准予许可，颁发水利工程启闭机使用许可证；不符合条件的，不予许可，书面通知申请人，并说明理由。
Tenth the Department of water administration under the State Council shall, according to the verification and product quality inspection report, within 20 working days from the date of receiving the application (not including verification of product quality inspection, the time required to make a decision whether or not to permit). If it meets the requirements, it may grant the license and issue a license for the use of the headstock gear for water conservancy projects; if it fails to meet the requirements, the applicant shall not be allowed to grant the permission; the applicant shall be notified in writing and the reasons shall be given.
第十一条 水利工程启闭机使用许可证应当载明企业名称、住所、生产地址、产品型式和规格、证书编号、有效期等内容。
Eleventh licenses for water conservancy works shall specify the name, address, production address, type and specification, certificate number and validity of the enterprise.
企业取得某种型式和规格产品的水利工程启闭机使用许可证的，可以生产该种型式和规格以及同一型式内小于该种规格的启闭机。
If the enterprise obtains the license for the opening and closing of water conservancy works with certain types and specifications, it may produce the type and specifications as well as the hoist in the same type which is smaller than that specification.
第十二条 取得水利工程启闭机使用许可证的企业，需要提高启闭机产品规格或者增加产品型式的，应当依照本办法第六条的规定提出申请。
Article twelfth enterprises that have obtained licenses for the use of water control works need to raise their specifications or increase the type of products, and they shall apply in accordance with the provisions of article sixth of these measures.
第十三条 水利工程启闭机使用许可证的有效期为5年。
The opening term of the thirteenth water conservancy project hoist is valid for 5 years.
水利工程启闭机使用许可证期满需要延续的，应当在有效期届满60个工作日前向国务院水行政主管部门提出申请。国务院水行政主管部门应当在有效期届满前作出是否延续的决定。
Water conservancy project hoist use license expiry needs to be extended, should be the expiry of 60 days prior to the water administrative department of the State Council to apply. The water administrative department of the State Council shall make a decision whether or not it will continue before the expiration of the term of validity.
第十四条 企业变更名称、住所、法定代表人的，应当自发生变更之日起30个工作日内向国务院水行政主管部门申请办理水利工程启闭机使用许可证的变更手续。
Fourteenth enterprises to change the name, domicile, legal representative, shall change the date of 30 working days after the water administrative department of the State Council to apply for water conservancy project hoist use license change procedures.
生产地址迁移的，应当向国务院水行政
Where the production address is transferred, it shall be submitted to the State Council for water administration

第一条 为了加强对水利工程启闭机质量的监督管理，保障水利工程运行安全，根据《中华人民共和国行政许可法》、《国务院对确需保留的行政审批项目设定行政许可的决定》，制定本办法。

前款第（二）、（三）、（四）项规定条件的具体要求见附件。
